Acceptance of Terms

By downloading, installing, or using any Chiaro Apps mobile application, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services.

Use of Our Services

Eligibility

You must be at least 13 years old to use our services. By accessing or using our website or mobile apps, you confirm that you meet this age requirement.

License Grant

Subject to your compliance with these Terms, Chiaro Apps grants you a limited, non-exclusive, non-transferable, revocable license to:

  • Download and install our mobile applications on devices you own or control
  • Access and use the applications for personal, non-commercial purposes
  • Receive updates and support as provided by Chiaro Apps

Acceptable Use

You agree to use our services only for lawful purposes and in accordance with these Terms. You agree not to:

  • Violate any applicable laws, regulations, or third-party rights
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt the integrity or performance of our services
  • Reverse engineer, decompile, or disassemble our applications
  • Use our services to transmit malicious code, spam, or harmful content
  • Impersonate any person or entity or misrepresent your affiliation
  • Collect or harvest information about other users without consent

User-Generated Content

If our mobile apps allow you to submit content (such as comments or feedback), you retain ownership of any intellectual property rights in your content. However, by submitting content, you grant us a worldwide, royalty-free, non-exclusive license to use, reproduce, and display your content as necessary to provide our services.

You are solely responsible for the content you submit and must ensure that it does not violate any third-party rights or applicable laws.

Privacy and Data Collection

We collect and process your personal information in accordance with our Privacy Policy. By using our services, you consent to such collection and processing. Key points include:

  • Email Addresses: We may collect email addresses from users via our mobile apps during onboarding.
  • Cookies and Analytics: Our website uses cookies, and both the website and mobile apps may utilize analytics tools (such as Google Analytics) to gather usage insights.
  • Advertisements: Our mobile apps may use advertising services (such as Google AdMob) to display personalized ads, which may involve sharing certain device information with third-party advertisers.

User Accounts

Some of our services may require you to create an account. You agree to provide accurate and complete information when creating an account and to keep this information up-to-date. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access or security breach
  • Providing accurate and complete information during registration

You may edit your account information or delete your account through our mobile apps, or by submitting a request through the contact form on our website.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activity.

Note: Some of our apps do not require you to create an account and do not collect any personal data. For these apps, account deletion or subscription cancellation requests are not applicable, as no user account or data is stored.

Intellectual Property Rights

All content, features, and functionality of our applications, including but not limited to text, graphics, logos, icons, images, audio clips, software, and design, are the exclusive property of Chiaro Apps and are protected by international copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our services without our express written permission. Any unauthorized use terminates the license granted in these Terms.

Premium Features and Payments

Some of our applications may offer premium features or subscriptions for purchase. By purchasing premium features, you agree to:

  • Pay all applicable fees as described at the time of purchase
  • Provide accurate and complete payment information
  • Authorize us to charge your payment method for recurring subscriptions
  • Review and comply with the refund policies of the applicable app store (Apple App Store or Google Play Store)

We reserve the right to modify pricing with advance notice to existing subscribers.

Google Play Store Apps

For apps distributed through the Google Play Store, subscriptions and in-app purchases are handled exclusively through Google Play. Refund eligibility is limited to:

  • Accidental charges
  • The most recent billing period, if the subscription was not used intentionally

Past subscription periods or previously used services are not eligible for refunds, as access to the full app features has already been provided. All refund requests for Google Play Store apps are reviewed individually and processed only for transactions still refundable through Google Play's order management system.

Apple App Store Apps

For apps distributed through the Apple App Store, refunds are handled exclusively through Apple's refund system and are subject to Apple's refund policies and procedures.

Consent to Share Consumption Data with Apple

By using our app and making in-app purchases, you consent to our sharing of data regarding your usage and consumption of purchased content with Apple, as part of our efforts to resolve refund requests. This information may include details about how you have accessed and interacted with the purchased content. The purpose of sharing this data is to help Apple make an informed decision regarding refund requests. Such data sharing is done in compliance with Apple's policies and only as necessary to process your requests.

Disclaimers and Limitations of Liability

Service Availability

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that our services will be:

  • Uninterrupted, secure, or error-free
  • Free from viruses or other harmful components
  • Accurate, reliable, or complete
  • Compatible with all devices or operating systems

Limitation of Liability

To the maximum extent permitted by law, Chiaro Apps and its affiliates, officers, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, data, or business opportunities
  • Service interruptions or system failures
  • Unauthorized access to or alteration of your data
  • Statements or conduct of third parties using our services
  • Actions or content provided by third-party services, including advertising and analytics providers

Our total liability for any claims arising from your use of our services shall not exceed the amount you paid to us in the twelve months preceding the claim, or $100, whichever is greater.

Indemnification

You agree to indemnify, defend, and hold harmless Chiaro Apps and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising from:

  • Your use or misuse of our services
  • Your violation of these Terms or applicable laws
  • Your violation of any third-party rights
  • Any content you submit or transmit through our services

Termination

We reserve the right to suspend or terminate your access to our services at any time, with or without notice, for any reason, including but not limited to:

  • Violation of these Terms of Service
  • Fraudulent, abusive, or illegal activity
  • Extended periods of inactivity
  • Technical or security reasons

Upon termination, your right to use our services will immediately cease. Provisions of these Terms that by their nature should survive termination shall remain in effect, including intellectual property rights, disclaimers, and limitations of liability.

Changes to These Terms

We may modify these Terms of Service at any time to reflect changes in our services, legal requirements, or business practices. We will notify you of material changes by:

  • Posting the updated Terms on our website with a new "Last updated" date
  • Sending an email notification to registered users
  • Displaying an in-app notification upon your next use of the service

Governing Law and Dispute Resolution

You waive any right to participate in class action lawsuits or class-wide arbitration.

Miscellaneous

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Chiaro Apps regarding your use of our services and supersede all prior agreements and understandings.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
